MALTA YACHT REGISTRATION

WHY MALTA?

Malta’s geographic location can be deemed to be an optimal and natural link to maritime activities having not only gained popularity as a yachting destination but also as a yachting jurisdiction. However, Malta’s success in the maritime industry is not solely granted by its location.

Malta has both strong legal and logistical advantages making it the largest ship and yacht registrar in Europe and the 6th largest registry in the world. Malta has also recently acquired “White Flag” Status in the Paris MoU Annual Report and the Tokyo MOU. As a jurisdiction one can confidently say that Malta has an enviable reputation whilst also being fiscally competitive and universally accessible.

The registration of yachts both pleasure and commercial must be done under the regulations of the Merchant Shipping Act of 1973, further supplemented by subsidiary rules and regulations.

A yacht can be registered as a private yacht where the minimum length of the vessel is 6 meters and must solely be used for the owner’s benefit and must not engage in the pursuing of profitability, or as a commercial yacht where the yacht is used in the furtherance of an economic activity, being at least 15 meters in length and carry a maximum of 12 passengers.

All types of Vessels are catered for under Maltese law; from pleasure yachts to commercial yachts and even taking into consideration vessels which are still undergoing construction.

PLEASURE YACHTS' REGISTRATION

The registration procedure of Pleasure Yachts is essentially divided into two, Provisional Registration; and Permanent Registration.

 

We are able to obtain the provisional registration within 1 to 3 days, this gives permission of free sailing of the yacht for a 6-month period, during which we will gather the remaining required documentation and provide it to the registry for the finalisation of the registration process to attain permanent registration.

DOCUMENTS 

REQUIRED

As a company we ensure that all documents requested by Transport Malta will be collected, documented and presented in time and in a duly manner. The owner will only be required to send the following documents to us and our dedicated team will take care of the rest. 

  1. Name Reservation and application;

  2. Proof of ownership through a bill of sale or equivalent documents;

  3. Proof of eligibility and Resident Agent;

  4. If a corporate entity :

    • Company's original Memorandum and Articles of Association;

    • An up-to-date Certificate of Good Standing.

  5. Evidence of Seaworthiness by a recognised surveyor;

  6. Surveyor must confirm that vessel is marked in accordance to Maltese law;

  7. Radio Inspection Certificate;

  8. If yacht is above 24M in length it must provide

    • Provision of international tonnage certificate;

    • Antifouling declaration

COMMERCIAL YACHTS

REGISTRATION

The registration process for commercial Yachts is almost identical to that of private pleasure yacht with the exception that the yacht must comply with the requirements of the Commercial Yacht Code. The Malta Commercial Yacht Registration classifies 3 types of yachts in which different level of safety standards are provided by the Commercial Yacht Code corresponding to each class.

  • Inspection Report;

  • Radio Application and Radio Report;

  • International load line certificate ;

  • International antifouling certificate;

  • MLC Compliance Certificate ;

  • Certificate of Survey;

  • Previous tonnage certificate;

  • If relevant, previous certificate of survey;

  • Safe manning application form;

  • Certified copy of previous registration certificate.

REQUIREMENTS FOR PERMANENT 

REGISTRATION

  • International tonnage certificate for Malta;

  • Certificate of Survey for Malta;

  • Original bill of sale, bearing a date prior to provisional registration.

  • Original Builders and deletion certificates;

  • Carving and Marking note;

  • For permanent yacht registration in Malta, the provisional registration certificate must be delivered.

PROVISIONAL REGISTRATION

UNDER CONSTRUCTION WITH

THE MALTESE FLAG

Maltese law also caters for vessels under construction, granting a provisional registration for the Yacht, provided that it satisfies the same requirements relating to survey and safety which are already built. This type of registration offers a plethora of benefits, including the deferral of numerous legal obligations typically relating to registration, until such time the construction is complete, or delivery of the Yacht is completed.

  • Confirmation from builder that the Yacht it is being built;

  • Confirmation from class that the Yacht is being built under their supervision (directly from class);

  • Application for registration;

  • Certificate of survey;

  • Original Memorandum and Articles of Association, if applicable;

  • Recent Good standing certificate, if applicable;

  • Power of Attorney, if applicable.

YACHT SALES & PURCHASES

We offer advice to Clients when selling and purchasing a new yacht. We will assist in both the requirements needed from the Maltese Registry for proper transfer of ownership and also in the drafting of all necessary documents.

RESIDENT AGENT

SERVICES

According to Maltese law, International owners willing to proceed with a Yacht Registration must appoint a resident agent. We can offer such a service in order to facilitate the process. We are able to sign and file applications on behalf of the International owner, pay fees and authenticate documents on behalf of the Owner.

CREW

Crew Employment structure based in Malta to employ all crew, including:

 

  • Crew Recruitment and Engagement in accordance with MLC requirements;

  • Execution of a Seafarer Employment Agreements (SEA’s);

  • Liaison with Transport Malta for Crew Certificates Endorsement;

  • Crew Payroll and Administration;

  • Registration of Crew for the payment of Social Security Contributions in Malta;

  • Repository of all crew emergency contact details of next of kin;

  • Arrangement of all travel for crew including repatriation, when required.
